I have just done my 4th course with PAMOVA Cymru and again I’ve really enjoyed it. Working for a nursing agency this course provides me with a wide range of knowledge and skills needed to carry out my job.What I really like about PAMOVA is the emphasis on restraint reduction and person centred approach’s. I did a two day restraint course with PAMOVA as part of my job in a children’s residential care home, but I had previously worked as a police officer and a prison officer where I also received training in restraint and the law regarding use of force.During the course I raised several serious concerns with the material being taught, which were not only dismissed by the trainers, but were reported back to my employers inaccurately and embellished beyond any kind of honest misunderstanding could possibly be. When I was asked where I obtained my knowledge of the law I was told I am no longer in the prison service so the law is different. This is not correct, the law is the law.During one of the many presentations we were shown it was clearly stated that pain compliance is torture under the ECHR, and when I stated that it was misuse of pain compliance that would be considered criminal assault or torture. The trainers responded by quoting BILD code of practice as if it was the law.BILD is a private organisation with a code of practice that is much more restrictive than the law permits with regards to physical intervention. This code of practice was repeatedly given precedence over the law.Throughout the presentations the principle of minimum force was repeated over and over, reinforced by reference to BILD’s code of practice. When I pointed out how ‘minimum force’ policies undermined the rights of staff and service users in their care under health and safety legislation, criminal law, and common law and that the correct terminology (in law) is reasonable force. Reasonable force means that use of force must be necessary, proportionate, and reasonable (and no more than reasonable) in the circumstances as they are understood at the time.These points were dismissed and yet again the BILD code of practice was quoted as law.After the course PAMOVA went back to my employer and stated in a blatant lie that I made a number of inflammatory comments. My line manager was present throughout the course and actually told me afterwards that if I had genuine concerns I should raise them to the director of the company I worked for. He also asked if I would attend further courses which I stated I would as it was a required part of my employment, but I would consider to challenge legally incorrect statements and practices that put staff and service users in unnecessary danger.A director for the company I worked for repeated these false allegations when they terminated my probationary period to preserve the 15 year relationship between the companies.Since this course I have trained as a self-defence instructor with a training provider that offers the most legally comprehensive courses on the market on self-defence and all types of physical intervention. During this training I met other instructors and trainees that have had issues with PAMOVA and the content of their courses.In my informed opinion this training provider’s courses will put staff and service users in greater harm by misinforming staff of their rights and responsibilities in law, and by generating fear in the use of justified and appropriate physical intervention.Addition to response:None of your instructors or anybody at your company was interested at the time!You can be part of as many associations as you like but the law is still the law, and yet again you quote BILD who are a private company not a regulatory body.There is no regulatory body because use of force is a matter of law!!
